The Texas Legislature has delegated the governance, control, jurisdiction, and management of Midwestern State University (“MSU” or “University"), a component institution of the Texas Tech University (TTU) System, to the TTU System Board of Regents (“Board”). The Board is vested by law with the authority to promulgate rules and regulations and to provide the policy direction for the University in accordance with the laws of the State of Texas for the safety and welfare of students, employees, and property (buildings and grounds), and for the governance of the institution. See Texas Education Code Section 109.002; Section 51.202; and Section 51.352. Texas court cases construing Texas Education Code Section 51.352 have held that the Board has wide discretion in exercising its power and authority and that the rules and regulations adopted by the Board have the same force as statutes.
The Board of Regents of the TTU System are charged by law to govern, control, and direct the policies of the TTU System, adopt, amend, and publish Regents’ Rules that include provisions relating to the governance of the Board of Regents:
- Board Meetings and Business;
- Board Officers and their Duties and Standards of Conduct; and the
- Organization and Administration of the TTU System
TTU System Regulations are developed to address specific directives and reporting requirements needed to implement TTU System Regents’ Rules and shall include interpretations where issues and specific guidelines are needed for uniform compliance.
MSU Operating Policies and Procedures (OPs -Public Access Link )
The TTU System Board of Regents has directed the President of MSU, with the appropriate participation of faculty, staff, and students, to cause to be prepared the operating policies and procedures (OPs) for the governance of the University and submitted for approval by the President and, if required, by the Chancellor and Board of Regents. The process for formulating, evaluating, revising, approving, issuing, and maintaining the OPs take into account the decentralized culture and institutional history of MSU, including our tradition of shared governance.
PowerDMS software provides the MSU community an easy way to manage and review OPs through the browser on any device. In collaboration with policy owners, PowerDMS facilitates the development, review, approval, revision, distribution, and maintenance of MSU OPs.
MSU reserves the right to make changes at any time to reflect current TTU System Regents’ Rules and regulations, MSU operating policies and procedures, and amendments required by state and federal law.
